Terms of Use.

By creating an account, clicking the acceptance button during sign-up, or using the Services in any other way, you express your full and unconditional acceptance of these Terms, as well as of the Legal Notice and the Privacy Policy. If you disagree with any of them, you must refrain from using the Services.

Zoku Athletics may modify these Terms to adapt them to regulatory, technical or business changes. Substantial modifications will be communicated by email or by prominent notice within the Service at least thirty (30) days before they take effect. If you do not accept the new conditions, you may cancel your account before that date at no cost. Continued use beyond that period implies acceptance of the updated version.

Zoku Athletics is a digital training and sports wellness platform that includes, among other features, WOD programming, multimodal timers, a catalog of benchmarks, session logging and tracking, AI Coach, Vital Flow metrics, social feed, the Solidary Reps charitable system, Rival Live rankings, third-party integrations and customer support.

AI Coach uses automated analysis. Google ML Kit processes the video or image entirely on your device to detect your posture: no frame, landmark or derived metric leaves your phone or is sent to Gemini. The response is identified as generated by automated analysis, may be inaccurate and does not replace a professional assessment; it does not produce legal decisions or significant equivalent effects on you.

Exception under review (2026-09-23). Separately, Vital Flow's "Adapt WOD" feature does send your fatigue index and, for each active injury, its location and severity, to Google Gemini to substitute contraindicated exercises. This processing is pending explicit consent and an Article 9 GDPR legal basis; until it is resolved, this clause does not cover that feature and it must not be presented as compliant. Details in the Privacy Policy.

To access all the Services it is necessary to create an account providing truthful, accurate and up-to-date information. Each User may have a single, personal and non-transferable account. You commit to safeguard your credentials and to immediately notify any unauthorized access through the support channels. Zoku Athletics is not responsible for damages arising from the loss, transfer or negligent use of credentials.

To register you must be at least fourteen (14) years old. Between 14 and 15 years of age, registration requires the express consent of the holder of your parental authority or guardianship and their active supervision; registration is not permitted under 14 years of age under any circumstances. Regardless of that age range, if you are between 14 and 17, any paid plan may only be purchased or confirmed by your legal representative.

Zoku Athletics offers a free plan, available through self-service, and two paid plans called "Pro" and "Elite", which today are shown as an informational catalog in the Your Subscription section, with their planned price, billing period and features. The paid checkout process is not active: showing a plan or contacting support does not authorize any charge or start a subscription. Prices are shown in euros and include applicable taxes when so indicated, and Zoku Athletics may modify them before contracting becomes operational.

Once paid contracting is available, you will be informed before any first charge of the price, the billing period and the provider that processes the transaction — expected to be Stripe Payments Europe, Ltd., acting as processor— and this section will be updated accordingly. Zoku Athletics will never store full card data.

While checkout is not active there are no charges, automatic renewals or trial period: there is nothing to cancel or refund. This section will be completed with the actual renewal, cancellation and management terms from Your Subscription once paid contracting becomes operational.

Right of withdrawal. Once paid contracting is operational, under Article 102 and following of Spanish Royal Legislative Decree 1/2007, you will have a period of fourteen (14) calendar days from contracting to withdraw from the contract without justification. However, under Article 103.m) of that text, the right of withdrawal will not apply when the supply of digital content has begun with your prior express consent and your acknowledgment that you lose that right.

Refunds: not applicable while there are no charges. Once contracting is operational, already-billed fees will not be refundable as a general rule, except for billing errors or when consumer regulations so require. Refund requests for exceptional circumstances may be sent to legal@zokuathletics.com and will be assessed case by case.

You undertake to make lawful, diligent and respectful use of the Services. The following is expressly prohibited:

• Impersonating another person or using third-party credentials without authorization.
• Publishing false, unlawful, defamatory, discriminatory, violent, pornographic content or content that infringes third-party rights (including intellectual and industrial property, honor, privacy and image rights).
• Interfering with the normal operation of the Service through mass scraping, reverse engineering, bots, denial-of-service attacks or any other unauthorized automated mechanism.
• Circumventing technical limitations, security measures or access control to paid features.
• Using the Services to send unsolicited commercial communications (spam) or to carry out affiliate marketing without express authorization.
• Collecting, storing or processing personal data of other Users outside the framework of the enabled social features.

Failure to comply with these obligations may result in the immediate, temporary or definitive suspension of the account and the exercise of any corresponding legal actions.

You own the content you post on the Service (feed posts, comments, kudos, avatar photo, training descriptions). By posting it you grant Zoku Athletics a worldwide, non-exclusive, royalty-free, sublicensable license, for the maximum term permitted by law, to reproduce, publicly communicate, adapt and distribute it in the context of providing, promoting and improving the Services.

You are solely responsible for the content posted and warrant that you hold the necessary rights over it, including, where applicable, the consent of identifiable persons appearing in images or videos. Zoku Athletics does not perform systematic prior supervision, but may remove content that is manifestly unlawful upon obtaining actual knowledge of it, in line with the LSSI and digital services regulations.

The software, design, navigation structure, the names "Zoku", the logos, the databases and the content created by Zoku Athletics are protected by intellectual and industrial property regulations and are owned by the Owner or by third parties that have authorized their use. This authorization to use the Service does not imply any transfer of intellectual or industrial property rights. Reproduction, distribution, transformation, public communication or any other form of exploitation, in whole or in part, is expressly prohibited without prior, express, written authorization.

The Services may optionally integrate with third-party services such as Spotify, Health Connect or the payment provider. Use of such integrations is governed by the terms and privacy policies of the respective providers and requires, where applicable, a specific OAuth authorization that you may revoke at any time from the app settings or the provider's panel. Zoku Athletics does not control or take responsibility for the availability, quality or data processing practices of such services.

Zoku Athletics provides the Services "as is" and uses reasonable technical means to ensure their availability and proper operation. Nevertheless, to the maximum extent permitted by applicable law, Zoku Athletics will not be liable for:

• Interruptions, delays, errors or data losses due to force majeure, failures of telecommunications providers, cloud infrastructure (Supabase, Google Cloud, Vercel) or third-party platforms (Stripe, Spotify, Firebase Cloud Messaging).
• Decisions or injuries arising from carrying out workouts based on the informational content of the Service.
• Indirect damages, loss of profit or loss of opportunity that are not reasonably foreseeable.
• Content posted by other users, without prejudice to moderation measures applicable after actual knowledge of its unlawfulness.

Nothing in these Terms limits or excludes Zoku Athletics's liability for willful misconduct, gross negligence or any other cause that, under applicable law, cannot be contractually limited. In the relationship with consumers, the mandatory rights recognized by consumer regulations will be fully respected.

Zoku Athletics may suspend or cancel the account when breaches of these Terms, fraudulent or abusive use of the Services, risks to the security of the platform or other users, or repeated non-payment of corresponding fees are detected. Suspension or cancellation will be notified to the User indicating the cause, unless communication is contrary to legal obligations or compromises an investigation. The User, for their part, may cancel their account at any time from /cuenta.

Any inquiry, complaint or claim can be addressed to the email address soporte@zokuathletics.com. Users subscribed to the "Elite" plan enjoy priority support, in accordance with the features highlighted on the pricing page. Standard response times are published in the support channels and are informational.

These Terms are governed by Spanish law. The parties submit, with express waiver of any other jurisdiction, to the Courts and Tribunals of the Owner's domicile for the resolution of any controversy arising from these Terms, unless the User qualifies as a consumer, in which case the mandatory jurisdiction provided in consumer regulations (generally, that of the consumer's domicile) shall apply.

Users who qualify as consumers may also access the European Commission's online dispute resolution platform (https://ec.europa.eu/consumers/odr).

• If any clause of these Terms is declared null or unenforceable, the rest will retain its validity and be interpreted respecting, as far as possible, the original purpose.
• These Terms, together with the Legal Notice and the Privacy Policy, constitute the complete agreement between the parties regarding the use of the Services and prevail over any prior communication.
• The User is not authorized to transfer their contractual position to third parties without prior written authorization from Zoku Athletics. The Owner may transfer the contractual position in cases of corporate restructuring, merger or transfer of activity, guaranteeing the same level of protection.
• Waivers of contractual rights are only valid if in writing.
