Zoku Athletics provides a digital training and sports wellness service aimed at adults, accessible through the Website and the App. The Services include, without limitation: workout timers and training schedules (WOD), a catalog of benchmarks, session logging, activity and performance metrics, a social and "Tribe" feed, a ranking system ("Rival Live"), charitable campaigns ("Solidary Reps"), integrations with third-party services (Spotify, Health Connect) and customer support via support tickets.

Certain features require a paid subscription ("Pro" or "Elite"). Subscription enrollment, pricing, renewal and cancellation are governed by the Terms of Use and by the information provided during the purchase process.

Access to the Services is free and open, except for the cost of telecommunications network access borne by the user. Use of features reserved for registered or subscribed users requires the creation of an account and, where applicable, the contracting of the relevant plan.

The user undertakes to:

• Make diligent, lawful and good-faith use of the Services, in accordance with this Legal Notice, the Terms of Use and applicable legal provisions.
• Provide truthful, accurate and up-to-date information on registration, purchase and support forms, and keep their personal and payment data updated.
• Safeguard their access credentials and immediately notify any unauthorized use of the account through the support channels.
• Refrain from using the Services for purposes or effects contrary to the law, morals, public order, or harmful to the rights or interests of the Owner or third parties.
• Not introduce, store or disseminate, through the Services, malicious code, unlawful, defamatory, discriminatory, violent, pornographic content, or content contrary to the dignity of individuals.
• Not carry out actions that may damage, overload, deteriorate or hinder the normal use of the Services, including scraping techniques, reverse engineering or automated attacks.

The Services are intended for adults. However, Zoku Athletics allows registration by persons over 14 years of age, which is also the minimum age of consent for data protection purposes set by Article 7 of Spanish Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights. Between 14 and 15 years of age, registration requires the express consent of the holder of parental authority or guardianship and active supervision of the use of the Services. Registration is not permitted under 14 years of age under any circumstances. Regardless of that age range, any paid plan taken out by a minor (aged 14 to 17) may only be purchased or confirmed by their legal representative. The Owner may request additional verification in case of reasonable doubt about the declared age and, if not provided, may cancel the account.

All content of the Website and the App - including, without limitation, texts, photographs, graphics, images, icons, trademarks, trade names, source code, design, navigation structure, databases and other elements - is owned by the Owner or, where applicable, by third parties who have authorized its use, and is protected by intellectual and industrial property regulations.

The names "Zoku", "Zoku Athletics", the logo and associated distinctive signs are trademarks and commercial signs of the Owner. Any reproduction, distribution, public communication, making available, transformation or any other form of exploitation, in whole or in part, requires the prior, express and written authorization of the Owner or the legitimate holder of the rights. In particular, framing, scraping, commercial deep-linking or any use that may mislead about the origin or ownership of the content is prohibited.

Content generated by users (texts, comments, kudos, avatar images, results published in the feed) shall remain their property. However, by publishing them in the Services, the user grants the Owner a worldwide, non-exclusive, royalty-free, sublicensable license, for the maximum term permitted by law, to reproduce, publicly communicate and adapt them for the purpose of providing and promoting the Services.

The Owner shall use reasonable means to ensure the availability, continuity and security of the Services. Nevertheless, it cannot guarantee the complete absence of interruptions, errors, viruses or other harmful elements that may alter the user's systems. The Owner is released from liability for damages that may arise from:

• Service interruptions, delays, errors or malfunctions of the Website or the App attributable to causes beyond its reasonable control, including those due to third-party infrastructure (hosting provider, domain registrar, payment gateways, notification services).
• Decisions made by users based on the information offered in the Services, especially regarding training planning, intensities and load volumes.
• Improper, unlawful or negligent use of the Services by third parties, including unauthorized access to the account when it is a consequence of the loss or transfer of credentials by the user.
• Content posted by third parties, including users of the social feed, which shall be their sole responsibility.

The Website and the App may include links or integrations with pages and services provided by third parties, in particular Spotify (music playback and OAuth authentication), Health Connect (activity and health data), Stripe (payment processing), Google and Supabase (authentication and storage). The Owner does not market, control or supervise the content, policies or practices of such third parties and disclaims any responsibility for them. Access to these services is governed by the conditions and privacy policies of their respective providers, which we recommend reading before use.

The Owner reserves the right to modify, at any time and without prior notice, this Legal Notice, as well as the presentation, configuration and content of the Services. Modifications shall take effect upon their publication on the Website. Periodic review of this page is recommended. Continued use of the Services after the publication of a modification implies acceptance of the new version.

This Legal Notice is governed by Spanish law. For the resolution of any controversy arising from access to or use of the Services, the parties submit to the Courts and Tribunals of the Owner's domicile, unless a different mandatory jurisdiction applies (for example, that of the consumer's domicile when the user qualifies as such under Spanish Royal Legislative Decree 1/2007).
